CueArrena Terms & Conditions

These Terms & Conditions ("Terms") govern your use of CueArrena — the mobile app, the developer portal at dev.cuearrena.com, and the real-time servers that host live games. By creating an account, installing the app, or otherwise using the platform, you agree to these Terms. If you do not agree, do not use CueArrena.

Your CueArrena account is the same account you use on cuearr.com. Additional terms from CueArr apply to the underlying CueArr code product; see cuearr.com/policy/tandc.php.

1. Acceptance of these Terms

These Terms are a binding agreement between you and CueArr (Canada), operator of CueArrena ("we", "us", "our"). By using CueArrena you confirm you have read, understood, and agreed to them, and to our Privacy Policy.

You agree not to:

Play safely. Scan-based games can encourage movement in the real world. You are solely responsible for your physical surroundings while playing. Obey traffic laws, respect private property, and stop playing if it is unsafe to continue.

5. User & game content

You retain ownership of the content you contribute (avatar photos, display name, chat messages, custom game input). By submitting content, you grant CueArrena a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and transmit that content solely for the purpose of operating the platform and delivering it to the other players in your games.

You are responsible for the content you submit, and you warrant that it does not infringe or violate any third-party rights.

We may remove content that violates these Terms or our policies, without notice where the situation requires it (e.g. clear illegality, imminent harm, or ongoing abuse).

6. Third-party developer games

CueArrena is an open platform: independent developers can publish games that other players join. When you play a developer's game:

If you publish games through dev.cuearrena.com you additionally agree to the developer terms surfaced during publish and to this section: you are responsible for the game you publish, you will not use CueArrena to collect personal data outside the gameplay purposes your players would reasonably expect, and you grant your players a licence to play the game they joined.

9. Location-based gameplay

Some games use your device's location for gameplay (geofencing, anti-cheat proximity checks). You choose whether to grant location, and at what level ("While Using the App" vs "Always"), through your device's OS prompt. You can change or revoke this at any time from your device Settings or from the CueArrena app's Preferences. Games that require location will simply refuse the actions that need it if you decline.

10. Service availability

CueArrena is provided on an "as available" basis. We may change, suspend, or discontinue any part of the platform at any time, and we may set limits on features or usage without notice. We will use reasonable efforts to keep the platform online but do not promise uninterrupted service, and are not liable for delays, downtime, or data loss caused by circumstances outside our reasonable control.

11. Community rules & enforcement

Every CueArrena player can report another player from the game roster or from a chat message. Reports go to a CueArrena moderator, who reviews the report along with the surrounding chat and the parties' prior history. We keep chat evidence strictly for moderation and only for as long as needed to review the report and any appeal (see the Privacy Policy).

We use an escalating sanction ladder so a single mistake doesn't produce a disproportionate response. The default progression, applied per account within a rolling twelve-month window, is:

  1. Warning — first incident; no gameplay block, incident recorded.
  2. 24-hour suspension — second incident.
  3. 3-day suspension — third incident.
  4. 7-day suspension — fourth incident.
  5. 30-day suspension — fifth incident.
  6. Permanent ban — sixth incident.

A moderator may skip directly to a permanent ban when the conduct is severe — for example threats of violence, content depicting the sexual exploitation of a minor, doxxing, or repeated hate speech. Sanctions older than twelve months drop off the ladder for the purposes of picking the next step, though the underlying incident record remains.

Auto-triage. When multiple distinct players report the same account within a short window, we may issue an automatic 24-hour suspension pending human review. A moderator confirms or lifts the auto-suspension during normal triage; a lift removes the sanction from your record.

False reports. Reporting is a trust mechanism, not a weapon. Reports we determine were filed in bad faith count against the reporter on the same sanction ladder above. Honest reports we ultimately dismiss carry no penalty; deliberate abuse of the report tool does.

Effect of a suspension. While an active suspension is in effect you cannot join or create games. You can still sign in, update your profile, appeal (see §11b), and delete your account.

11a. Suspension & termination

We may suspend or terminate your access to CueArrena if you breach these Terms, if your use creates risk to us, to other users, or to third parties, or if we are legally required to. Where the situation permits, we'll give you notice and a chance to remedy.

You may terminate your account at any time by deleting it from the CueArrena app's Preferences (Settings → Preferences → Delete account) or at cuearr.com/account/delete. Deletion applies to both CueArr and CueArrena because you share a single underlying account. See the Privacy Policy for what happens to your data after deletion.

Termination does not affect rights and obligations that by their nature should survive (payment for purchases already made, IP ownership, disclaimers, limitation of liability, indemnities, governing law).

11b. Appeals

You may appeal any active suspension once. The appeal is submitted directly from the CueArrena app's suspension notice screen and reviewed by a moderator who was not involved in the original decision where practical. Two outcomes:

Appeals are typically reviewed within a few business days. If you cannot reach the app to file an appeal, email appeals@cuearr.com from the email on your CueArrena / CueArr account and include the suspension reference number if you have it.

12. Intellectual property

CueArrena, the CueArr code system, the CueArr and CueArrena names and logos, and all associated software, artwork, and content are owned by us or our licensors and are protected by copyright, trademark, and other laws. Except for the limited licence to use the platform granted by these Terms, no rights are granted to you by implication.

13. Feedback

If you send us ideas, suggestions, or feedback, you agree we may use them without restriction and without owing you compensation.

14. Disclaimers

To the fullest extent permitted by law, CueArrena is provided "as is" and "as available" without warranties of any kind, express or implied — including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of the course of dealing or usage of trade. We do not warrant that the platform will be uninterrupted, error-free, or fully secure, or that any particular game or feature will continue to exist.

Nothing in these Terms limits any warranty that cannot legally be excluded (for example, statutory consumer-protection warranties in your jurisdiction).

15. Limitation of liability

To the fullest extent permitted by law, CueArrena, its owners, contractors, and licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunity, arising out of or in connection with your use of the platform.

Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or the platform will not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) CAD $100.

16. Indemnity

You agree to indemnify and hold harmless CueArr, its officers, contractors, and licensors from and against any claims, losses, damages, and reasonable legal fees arising out of your use of CueArrena in violation of these Terms, of applicable law, or of any third party's rights.

17. Governing law & disputes

These Terms are governed by the laws of the Province of Ontario, Canada and the federal laws of Canada applicable there, without regard to conflict-of-law principles. The exclusive venue for any dispute arising out of or relating to these Terms is the courts of Ontario, Canada, and you consent to their personal jurisdiction — unless the mandatory law of your country of residence gives you an unwaivable right to bring the dispute in your local courts, in which case that right applies.

If you download CueArrena from the Apple App Store, the following also apply:

19. Changes to these Terms

We may update these Terms from time to time. Material changes will be surfaced in the app on next launch and, where we have your email on file, communicated by email at least 14 days before they take effect. Continued use of CueArrena after the effective date of a change constitutes acceptance of the new Terms; if you don't agree, delete your account.
